A team of experienced litigators in the UK has promised maximum payouts as the new Enterprise and Regulatory Reform Bill seeks to become more "enterprise-friendly" at the expense of the workers.
Proposed by business secretary Vince Cable, the bill is expected to be passed this summer and will tilt the power of firing workers to the companies’ favor.
Adam Pavey, Director of Litigation & Employment of PLS Solicitors, said that there are other glaring provisions in the proposed bill that discriminates against the workers.
For example, he said, the bill imposes a limit to how much the worker can get in compensation claims. The limit can either be £74,200 or the 12 months worth of salary. But even if the bill has not yet been passed, there’s already a move to bring the payments to around £25,000 which could disadvantage the workers even further.
Unfair dismissal is a concept defined by Employment Rights Act of 1996. The law says that an employer could not just dismiss anybody by virtue of discrimination such as by race, beliefs or condition or the specified employee rights.
"You can make a claim not only for the basic awards which will depend on the length of service as well as your age at the time of the dismissal," Pavey said, adding that the worker can also claim for compensatory awards.
He explained that compensatory award can be given if the following conditions are present: first is the loss of wages up to the date of the tribunal, the loss of benefits and the future loss of wages.
The period where the worker has to be in the service of the employer has also been extended from one to two years before the unfair dismissal will be recognized.
But there’s a bigger threat for the workers once the proposal is passed because they will have to foot the bill if they take their employee for trial before a tribunal. Under the new proposal, a worker will pay £250 for filing a standard claim and another £950 if the case goes to a trial.
"Before this bill, this kind of process is free," he said.
